Trial over Corpbank Siphoning Off Began, Vassilev Asks for Discontinuance


The court sitting on the case for siphoning off of more than BGN 2 and a half billion from the Corporate Commercial Bank on 28th of February continues for second day In the Specialised Court. The former banker and majority shareholder of the bank, Tzvetan Vassilev, and other 17 people are defendants in the process, charged as an organised criminal group.

At the beginning of the sitting, the defence read a letter from Vassilev, who is in Belgrade, and will be tried in absentia, as alleged leader of the criminal group, that siphoned off the 2 and a half billion.

In the letter, the former banker urges the court to discontinue the case. Instead, he said, there should have been a lawsuit for alleged organized bank run to make the bank bankrupt and enrichment through asset plundering. Vassilev claims that the credits referred to in the indictment, which are one third of the Bank's entire portfolio, were operating and complying with the laws. This was reflected in all reports and audits of the Bulgaria’s central bank, BNB. Not a signle coin of these credits went into his pocket or the pockets of any of the other defendants. According to Vassilev, Corpbank’s liquidity has been damaged as a result of the actions of the prosecutor's office and the attacks in certain media.

The court is currently hearing the arguments of the lawyers claiming that the case should be discontinued because serious procedural violations have been committed. They gave examples of how to file a charge in absentia and the prosecution's refusal to interview Vassilev via videoconference.

Η όλη ταλαιπωρία που περάσαμε το 2014, μου άφησε ένα κουσούρι στην καρδιά, όπως σου είχα πει, τότε που είχα εξαφανιστεί και νόμισες πως με ξεμυάλισα κάποια Βουλγάρα. Τώρα είμαι πολύ καλύτερα. Ευτυχώς ξεπέρασα. Γι'αυτό λέμε υγεία πάνω απ`όλα.

DEPOSITARY WON A LAWSUIT AGAINST THE BNB FOR BLOCKED MONEY IN THE CCB

The depositor in the bankrupt KTB, Nikolay Kantarev, sentenced the Central Bank to pay him 1,835.72 leva as compensation for the blocked access to his money for more than 5 months. The Administrative Court of Varna has accepted that the BNB violated EU law by delaying its decision to declare deposits in the CCB as unaffiliated.

According to the court, CCB depositors should have started receiving their money from the Deposit Insurance Fund as early as July 25, 2014. Instead, the central bank has allowed access to deposits until December 4th. Kantarev is among the victims of the collapse of the CCB and its closure in the summer of 2014. His deposit account was closed off officially and his money was paid by the Deposit Guarantee Fund but after 5 months of delay. The benefit now awarded to him is in fact the difference between the statutory default interest for that period and that charged on his deposit of BGN 84,300.

The ruling of the Administrative Court in Varna came after consulting the European Court of Justice (CJEU) in Luxembourg. In the summer of last year, the CEC issued an opinion that allowed Kantarev. Now, in practice, the Varna court is complying with the recommendations of the European Court. This may unleash a wave of claims from injured bona fide depositors in a bankrupt bank. The dispute arose as in Bulgarian law, in force in 2014, the payment of the money was linked to the revocation of the bank's license. The CCT license was withdrawn on 6 November 2014 - almost 5 months after the bank closed and was placed under special supervision on 20 June 2014. Subsequently, the bankruptcy case set the date of insolvency on 20 June 2014.

However, the GATS regulates otherwise. It provides that secured deposits must be repaid within 5 days after the competent authorities have established their unavailability, that a credit institution does not pay the due and payable deposits. "This should not depend on the decision on the insolvency of the credit institution and the withdrawal of its authorization. Failure to comply with this requirement constitutes a sufficiently serious breach of EU law to engage the responsibility of the state, "the CES said.

Against this background, the Administrative Court of Varna states: "Having not taken this decision within the mandatory five-day period, the BNB violated EU law. This violation is judged by the current composition and as sufficiently significant to engage the responsibility of the state. " In the decision, Judge Iskrena Dimitrova also stated that the BNB violated the right of the depositor, guaranteed by the European Convention on Human Rights. "The plaintiff was in possession of movables - cash, the property rights which he could not have exercised because of the BNB's inaction to protect this property". The decision of the Varna Administrative Court is not final and may be appealed before the Supreme Administrative Court.
